Most higher education administrators are familiar with Title IX but until recently, many felt that Title IX focused exclusively on athletics. However, in 2011, the U.S. Department of Education’s Office of Civil Rights released guidance refocusing attention around Title IX’s true purpose: ensuring gender equity in all educational activities.
The letter, commonly referred to as the Dear Colleague Letter, caught many in higher education off guard. Here, we focus on 5 aspects of Title IX that deserve your attention:
#5 – DESIGNATE A TITLE IX COORDINATOR
All institutions of higher education receiving Title IV funds must designate at least one Title IX Coordinator.
#4 – PUBLICIZE WHO THE TITLE IX COORDINATOR IS:
Beyond designating a Title IX coordinator, you need to also publicize who the Title IX coordinator is for your institution.
#3 – PROVIDE TITLE IX TRAINING TO STUDENTS, FACULTY, AND STAFF
Providing an annual training on issues of sexual misconduct is an important component of Title IX compliance.
#2 – PROVIDE A FAIR AND EQUITABLE PROCESS TO RESOLVE ALLEGATIONS OF SEXUAL MISCONDUCT
Institutions must design and use a process that is fair and equitable to resolve issues of sexual misconduct while using a preponderance of evidence standard.
#1 – CONDUCT A SEXUAL MISCONDUCT CAMPUS CLIMATE SURVEY
Currently, legislation is being considered that would require all institutions to conduct a campus wide survey on sexual misconduct and while not currently required, a sexual misconduct campus climate survey is considered a best practice by many experts and is a valuable tool that can assist you in understanding the perceptions and awareness of Title IX sexual misconduct issues on your campus.
